										<content:encoded><![CDATA[<p><a href="https://www.canadavisa.com/landing-settlement-canada-british-columbia.html">British Columbia’s</a> Ministry of Post-Secondary Education and Future Skills recently published new measures to improve the integrity of the province’s international student program.</p>
<p>A release from the Ministry says it is introducing new protections and setting higher standards for designated learning institutions in the province. One of these protections is the Education Quality Assurance (EQA) code of practice.</p>
<p>There are three main objectives under the EQA. To start, <a href="https://www.canadavisa.com/designated-learning-institution-list.html">Designated Learning Institutions</a> (DLIs) in B.C. will be working on &#8220;limiting international student enrolment to 30% of an institution’s total enrolment.”</p>
<p>This limit will only apply to the province’s public DLIs. Private DLIs are not impacted.</p>
<p>In an email to CIC News, a Ministry representative said that many of British Columbia’s 25 public post-secondary educational institutions were already under that percentage of international student enrolment.</p>
<p>When asked if this 30% cap on international student enrolment was on top of the current provincial limit of international students, as dictated by the number of <a href="https://www.canadavisa.com/canadian-provincial-attestation-letters.html#:~:text=The%20PAL%20is%20a%20method,respective%20allocation%20of%20international%20students.">Provincial Attestation Letter</a>s  (PALs) B.C. will issue this year, the Ministry did not specify but did say that the distribution of attestation letters was based on supporting and supporting international student programs at public DLIs.</p>
<p>They also said that Ministry staff will work with institutions to provide time to adjust their student recruitment to meet the target and manage any financial implications. The Ministry says institutions will use their international education strategic plans, identified in the new guidelines, to discuss their strategies to meet the threshold.</p>
<p><a href="https://www.cicnews.com/2024/03/british-columbia-now-issuing-provincial-attestation-letters-for-international-students-0343286.html#gs.cqdkrg">British Columbia received an allocation of 83,000 PALs  for 2024</a>. These letters verify that a student has been accepted to a DLI in a given province. They are a new step to obtaining a study permit in Canada that was introduced by <a href="https://www.canadavisa.com/ircc.html">Immigration Refugees and Citizenship Canada</a> (IRCC) following the announcement of a cap on the number of study permits the department will process over the next two years.</p>
<p>The number of PALs a province is allocated is based on population. British Columbia is Canada’s third most populated province after Ontario and Quebec. How provinces then distribute letters among DLIs is up to provincial governments. In B.C., 53% of PALs will be issued to public post-secondary institutions in 2024 and 47% will go to private institutions.</p>
<h2>Transparent fees for international students</h2>
<p>B.C. says DLIs in the province will also be expected to post tuition levels for students for the entire time they are studying. This will allow incoming students to know how much their entire education will cost before they start and will help them budget for life in Canada.</p>
<p>International students contribute heavily to Canada’s economy. A recent report by Global Affairs Canada found that in 2022, international student spending amounted to over $37 billion. Data from Statistics Canada also shows that in the 2023/ 2024 academic year international undergraduate students paid an average of $38,081 in just tuition. B.C. currently hosts 111,900 international students in public institutions.</p>
<h2>Meeting standards</h2>
<p>As part of the EQA, the province will also require that institutions “meet or exceed the institutional quality assurance standards set by the province and is required for all public and private institutions enrolling international students.”</p>
<p>These standards include the &#8220;development of international education strategic plans, improved student services, housing supports, and standards to ensure Indigenous and domestic students are not displaced.&#8221;</p>
<p>Meeting these standards builds on the <a href="https://www.cicnews.com/2024/02/provinces-introducing-measures-to-improve-integrity-of-post-secondary-education-for-international-students-0242685.html#gs.cqg9xm">International Framework Measures the province introduced last January.</a> These measures included pausing the growth of the number of DLIs in the province, increasing oversight of private institutions and strengthening and publishing compliance and enforcement actions. The province considers the new measures as Phase 2.</p>
<p>DLIs that follow the code will receive an EQA designation. Those that do not meet the EQA code of practice will lose their EQA designation, making them unable to accept international students.</p>

<p>However, there are also several benefits to attaining PR that many newcomers may not be aware of, including easier access to all kinds of education, employment, and support opportunities. While these are often not the sole reasons that one immigrates to Canada, they can be hugely beneficial to new immigrants looking to start a new life in the country.</p>

										<content:encoded><![CDATA[<p>According to a <a href="https://www.reliablevisas.com/">recent Nanos Research poll</a>, a significant majority of Canadians recognize the importance of temporary foreign workers (TFWs) to the country&#8217;s economy.</p>
<p><a href="https://www.reliablevisas.com/">The survey</a> of 1,006 people, conducted online and over the phone between December 27 and 29 last year, revealed that over 80% of Canadians “feel that temporary foreign workers are important to the country’s economy.”</p>
<p><strong>Note:</strong> The results of this poll, conducted by Nanos for the Globe and Mail, were released on January 9, 2023.</p>
<p>This revelation comes around the same time as another <a href="https://www.reliablevisas.com/">Nanos poll last September revealed</a> growing numbers opposed to increased immigration.</p>
<h3>Growing general opposition against immigration across Canada</h3>
<p>In contrast with the results of this most recent poll, the Nanos Research poll from September 2023 revealed that <a href="https://www.reliablevisas.com/">over half of Canadians surveyed</a> expressed a desire for Canada to welcome fewer immigrants than the figure targeted by the federal government.</p>
<p>Up from 34% in March last year, 53% of survey respondents in September indicated that “they want to see Canada accept fewer immigrants than the federal plan.” This desire also extended specifically to Canada’s international student population, as the same September poll revealed that “55% of Canadians want Canada to accept fewer international students than the 900,000 expected by the government.”</p>
<p><strong>Temporary resident population growth in Canada</strong></p>
<p>In light of a declining level of national support for immigration, it is worth understanding where much of Canada’s recent immigration growth has come from.</p>
<p>According to <a href="https://www.reliablevisas.com/">data released by Statistics Canada</a> (StatsCan) in December, Canada’s population grew by more than 430,000 during the third quarter of 2023. This increase, which according to StatsCan estimates was driven largely by immigration, <a href="https://www.reliablevisas.com/">included</a> “about 313,000 non-permanent residents [who mostly] came to Canada on work or study permits.”</p>
<h3>Canadians support TFWs coming to Canada for specific employment</h3>
<p>Despite a growing sentiment against increased immigration, the <a href="https://www.reliablevisas.com/">Nanos poll released in January</a> indicates that Canadians “are more supportive of migrants coming to do specific jobs.”</p>
<p>According to <a href="https://www.reliablevisas.com/">Nanos Research chairman Nik Nanos</a>, “when it comes to people coming to Canada for a purpose, such as temporary foreign workers, there’s pretty good levels of support and acceptance.”</p>
<p>On one hand, general support for welcoming more “temporary foreign workers for jobs” was expressed by 57% of Canadians who took part in the Nanos poll in December. According to polling details, this support is highest in Canada’s Atlantic provinces among people older than 55. The poll also notes that 49% of respondents in the Prairie provinces indicated support for an increase.</p>
<p>In addition, 35% of Canadians said they oppose allowing more temporary foreign workers to come to Canada for jobs. Among all provinces and territories across Canada, Nanos found that this opposition was strongest in Ontario, the Prairies and British Columbia.</p>
<p>However, the January Nanos poll also found that 79% of Canadians “support employers bringing temporary foreign workers into Canada to help fill jobs they can’t find Canadians to do.” This type of support for TFWs was found to be strongest in Atlantic Canada as well as Quebec and weakest in Ontario and Canada’s prairie provinces.</p>
<h3>Government response to the shifting sentiment around immigration in Canada</h3>
<p>Acknowledging that there is a “correlation between [Canada’s] influx of international students and temporary workers and the [national] housing shortage in Canada” according to a recent <a href="https://www.reliablevisas.com/">Globe and Mail story</a>, Immigration Minister Marc Miller said he plans to “rein in” the number of temporary foreign workers coming to Canada.</p>
<p>This was also mentioned in a <a href="https://www.reliablevisas.com/">recent CBC News story</a>, where Miller was also quoted as saying that the federal government may need to look into “really controlling the volume” of temporary residents coming to Canada.</p>
<p>To accomplish this, according to <a href="https://www.reliablevisas.com/">the Globe and Mail</a>, Miller has suggested that reforms may be coming to both Canada’s “Post-Graduate Work Permit [PGWP] system for international students … as well as the temporary foreign workers program.”</p>
<p>According to Miller, as quoted again in the same Globe and Mail story, “both [the PGWP and the TFW program] represent increased volume that we’ve seen jump astronomically in the last few years, even when you net out the period during COVID-19.”</p>
<p>It’s something that has created some unanticipated effects and something we need to rein in. I’m prepared to do it.”</p>

										<content:encoded><![CDATA[<p>In Canada, people who are inadmissible to this country are issued either a departure order, an exclusion order, or a deportation order by <a href="https://www.reliablevisas.com/">Immigration, Refugees and Citizenship Canada</a> (IRCC) and/or the <a href="https://www.reliablevisas.com/">Canada Border Services Agency</a> (CBSA).While it may seem like this would conclusively end an individual’s journey in Canada, the Canadian government offers a document called an <a href="https://www.reliablevisas.com/">Authorization to Return to Canada</a> (ARC), which could provide the removal order recipient with an opportunity to return to Canada in the future.Understanding ARCs first requires a basic understanding of Canada’s three different types of removal orders, which are listed below in order of severity.</p>
<h3>Departure orders</h3>
<p>When departure orders are issued, the recipient is required by law to leave Canada within 30 days of when the order takes effect. As part of their obligations under a departure order, the recipient must confirm their departure with CBSA when they reach the port of exit.</p>
<p><strong>Note:</strong> Departure orders can evolve into deportation orders if the recipient either does not leave Canada within the prescribed 30 calendar day period or neglects to confirm their departure with CBSA when they arrive at their port of exit. The consequences of such an evolution, from departure to a deportation order, will be discussed later.</p>
<h3>Exclusion orders</h3>
<p>Exclusion orders build on the severity of departure orders by restricting the recipient’s ability to re-enter Canada, under most circumstances, for a minimum of one year. Individuals may, however, be blocked from coming back to Canada for up to five years if the initial exclusion order was issued on the basis of misrepresentation. If given an exclusion order that has required the CBSA to pay for the individual’s removal from Canada, the excluded person is obligated to repay that amount to the CBSA.</p>
<h3>Deportation orders</h3>
<p>Deportation orders are designed to permanently bar any recipient from returning to Canada unless they apply for an ARC (more on ARCs later). Again, any deported individual who has had their deportation paid for by the CBSA must pay back any removal costs to the agency. With this type of removal order, the above-described repayment is required for a deportee to be considered for re-entry into Canada (on top of an ARC).</p>
<h3>What is an Authorization to Return to Canada, and when would I need one?</h3>
<p>An ARC is the only way for deportation order recipients to be considered for re-entry into Canada. In other words, an ARC is not necessary for re-entry to Canada if the removal order handed down was a departure or exclusion order. Details on re-entry to Canada after receiving those two types of removal orders are as follows:</p>
<p>Persons that receive a <a href="https://www.reliablevisas.com/">departure order</a>, presuming they followed the required procedures when departing Canada, “may return to Canada in the future [if they] meet the entry requirements at that time.” Of course, if an individual was initially given a departure order that has since evolved into a deportation order, an ARC would then be required if the person wanted to eventually return to Canada.For recipients of an exclusion order, an ARC is only necessary if the individual would like to explore the possibility of returning to Canada prior to the conclusion of their exclusion period — between one to five years, depending on the circumstances behind their order.</p>
<p>Returning to Canada’s most severe type of removal order, an ARC is always required when a Canadian deportee is seeking re-entry into the country. In other words, regardless of the circumstances behind any individual deportation, all deportation order recipients must apply for ARC whenever they seek re-entry, irrespective of the time that has passed since the order was handed down.</p>
<h3>Details about ARCs</h3>
<p><strong>Note:</strong> ARCs include a processing fee of $400 CAD. More details on specific ARC application steps can be found on the Canadian government’s <a href="https://www.reliablevisas.com/">website</a>.</p>
<p>In all circumstances other than one, an ARC application must accompany another application. This is because <a href="https://www.reliablevisas.com/">ARC applications</a> are specifically intended to be “processed and reviewed in the context of that [other] application.”</p>
<p>For instance, the recipient of an exclusion order may submit an ARC application alongside a Temporary Resident Visa (TRV) application so that the two submissions are processed together.</p>
<p>The single circumstance under which an ARC can be processed on its own is when the applicant does not require a visa to enter Canada. As an example, this would be the case if an Australian citizen was seeking entry to Canada because that individual would be a citizen of a visa-exempt country.</p>
<p>The key to ARCs, however, is that they are ultimately circumstantial and discretionary in nature. As evidenced by <a href="https://www.reliablevisas.com/">the case of Adina Harms-Barbour</a>, a German citizen who lived as a permanent resident (PR) in Canada since the age of seven but was ordered to be deported in early 2021 for serious criminality, no guarantee can be made that any removal order recipient will surely be granted an ARC.Instead, such a decision will rest entirely in the hands of the Canadian government and be contingent on the specific context of a person’s individual situation.</p>

										<content:encoded><![CDATA[<p>According to <a href="https://www.reliablevisas.com/">British Columbia’s</a> recently released Labour Market Outlook report, the province will add 1 million jobs to its workforce by 2033.The Labour Market Outlook report is a 10-year forecast of the province&#8217;s in-demand careers, skills training and education, as well as the industries that may be hiring.</p>
<p>The report shows that 65% of the new job openings will be to replace workers who are retiring in British Columbia (BC). It is expected that up to nine million Canadians will be retired by 2030.</p>
<p>The remaining 35% (345,000) of jobs in BC will be an expansion of the provincial workforce. BC’s government forecasts an annual average employment growth of 1.2% per year. This means that by 2033, BC’s workforce will grow to include 3.1 million people.</p>
<p>The report expects that new immigrants to the province will make up 46% of new job seekers by then. This is up 25% from the Labour Market Outlook report released five years ago. BC’s government says that 470,000 new immigrant workers are expected to arrive in the province over the next decade. This accounts for both <a href="https://www.reliablevisas.com/">permanent</a> and temporary residents.</p>
<p>The province says<a href="https://www.reliablevisas.com/"> higher than previously expected immigration levels</a> and an increase in labour force participation for key age groups means that the number of job seekers will match the number of new job openings.</p>
<p>The report notes that 75% of expected job openings will require some post-secondary education or training.</p>
<h2>Occupations and training</h2>
<p>Alongside the report, the province has included a list of the occupations that will have the highest number of opportunities for people looking to enter BC’s labour force. The list is broken down into the level of education needed for the occupations:</p>
<p><strong>Degree:</strong></p>
<ul>
<li>registered nurses and registered psychiatric nurses</li>
<li>elementary school and kindergarten teachers</li>
<li>software engineers and designers</li>
</ul>
<p><strong>College diploma or apprenticeship:</strong></p>
<ul>
<li>social and community service workers</li>
<li>early childhood educators and assistants</li>
<li>police officers (except commissioned)</li>
</ul>
<p><strong>High school and/or occupation specific training:</strong></p>
<ul>
<li>letter carriers</li>
<li>couriers and messengers</li>
<li>mail and parcel sorters, and related occupations</li>
</ul>
<p>To help ensure residents have the skills and training they need to succeed in one of these high-demand occupations, BC is working to expand access to training in several fields. According to the province, it is already making steps toward several new programs including:</p>
<ul>
<li>funding 602 new nursing seats at colleges and universities throughout BC – adding to the approximately 2,000 existing nursing seats in the province;</li>
<li>creating a new medical school at Simon Fraser University and adding 40 new undergraduate medical education seats and as many as 112 new residency seats at the University of British Columbia’s faculty of medicine;</li>
<li>creating more than 1,700 additional early childhood educator (ECE) spaces and providing 6,500 bursaries to ECE students since 2018;</li>
<li>adding approximately 6,000 new tech-relevant spaces since 2017; and</li>
<li>providing $271.3 million toward Vancouver Community College’s new Centre for Clean Energy and Automotive Innovation. The training facility will accommodate as many as 1,400 students each year with new programs in clean-energy technology, light rail and zero-emissions vehicle repair and technology.</li>
</ul>
<h2>BC Provincial Nominee Program</h2>
<p>To help aid the province in expanding its workforce, British Columbia invites candidates to apply for provincial nomination every week (with some exceptions) through the <a href="https://www.reliablevisas.com/">British Columbia Provincial Nominee Program</a> (BCPNP).</p>
<p>Through the BCPNP, the province can target and select the economic immigration candidates who are most likely to easily integrate into the provincial economy. It can do this because immigration is a shared responsibility between the federal and provincial governments.</p>
<p>Reports such as the Labour Market Outlook help inform the BC PNP on what attributes to focus on when issuing invitations.For example, <a href="https://www.reliablevisas.com/">almost every other week</a>, the province holds a draw for candidates in a tech occupation. It also invited Early Childhood Educators and Assistants and candidates in healthcare occupations in every draw of 2023.he province has also recently started targeting candidates who work in construction occupations.</p>

<h3>How does IEC function?</h3>
<p>Citizens of partner nations that have bilateral Youth Mobility Agreements with Canada; and who are within the eligible age range (18-29, 18-30, or 18-35, (all-inclusive)—depending on the <a href="https://www.reliablevisas.com/">nationality of the applicant</a>) may qualify for an IEC work permit.</p>
<p>Similar to programs within Canada’s <a href="https://www.reliablevisas.com/">Express Entry</a> management system, the IEC functions on a candidate/applicant system. Interested individuals may submit a candidacy profile to IRCC (if they meet all <a href="https://www.reliablevisas.com/">basic eligibility requirements</a>). At this point they are candidates. If the department selects a candidate’s profile, they are then invited to apply for consideration to receive a work permit. Once this application has been submitted, candidates are now applicants—and one step closer to receiving their work permit.</p>
<p>Under the program, applicants may receive a work permit under one of three streams:</p>
<ul>
<li>The <a href="https://www.reliablevisas.com/">Working Holiday stream</a>, which grants an <a href="https://www.reliablevisas.com/">Open Work Permit</a> (OWP) for up to two years, allowing holders to work for most employers in Canada, in most industries;</li>
<li>The <a href="https://www.reliablevisas.com/">Young Professionals stream</a>, which issues an employer-specific (or <a href="https://www.reliablevisas.com/">LMIA-based</a>) work permit for individuals who have a job offer, and plan to work with a single employer in Canada; and</li>
<li>The <a href="https://www.reliablevisas.com/">International Co-op Internship stream</a>, which allows citizens of participating countries, who are enrolled in a post-secondary program (in their country of citizenship), to enter Canada and intern/work for a specific Canadian company. Applicants must already have arranged co-op placements before applying.</li>
</ul>
<h3>Basic eligibility</h3>
<p>Candidates applying under the IEC must:</p>
<ul>
<li>Be a citizen / passport holder of one of the <a href="https://www.reliablevisas.com/">35+ partner countries</a> that have Youth Mobility Agreements with Canada;</li>
<li>Have a valid passport for the duration of their stay in Canada;</li>
<li>Be within the eligible age range (18-29, 18-30, or 18-35, (all-inclusive), depending on the <a href="https://www.reliablevisas.com/">applicant&#8217;s nationality</a>) at the time of their application;</li>
<li>Have the equivalent of $2,500 CAD upon landing in Canada;</li>
<li>Be able to take out health insurance for the duration of their stay;</li>
<li>Be <a href="https://www.reliablevisas.com/">admissible</a> to Canada;</li>
<li>Have (prior to departure) a round-trip ticket or the financial resources to purchase a departure ticket at the end of their authorised stay in Canada;</li>
<li>Not be accompanied by dependents; and</li>
<li>Pay the appropriate <a href="https://www.reliablevisas.com/">fees</a>.</li>
</ul>
<h3>How does the IEC benefit Canada?</h3>
<p>The IEC helps Canada address labour shortages that continue to bother many of the country’s industries (including wholesale and retail trade, manufacturing, construction, and others). Immigration is a key source of workers, making the bilateral agreements Canada holds with partner IEC countries advantageous in providing young labour to key sectors—while also giving foreign and Canadian youth the opportunity to gain international work experience. These IEC workers further become eligible to <a href="https://www.reliablevisas.com/">immigrate permanently to Canada</a> after gaining the requisite amount of work experience, potentially adding to Canada’s labour force long-term.</p>
<p>This year’s IEC intake has held steady with <a href="https://www.reliablevisas.com/">last year’s intake expansion</a>, showcasing the important role that IEC workers have in the Canadian economy. 2024 is expected to see the inclusion of Finland into the list of partner countries, with both nations set to ratify their new youth mobility agreement sometime in the coming year.</p>

<p><span data-contrast="auto">Today, invitations were issued to candidates who are eligible for category-based selection in healthcare occupations. In total, 1,500 candidates were invited. Candidates required a minimum CRS score of 463. This is lowest CRS score of any Express Entry round of invitations issued in 2023.</span></p>
<p><span class="ui-provider fz b c d e f g h i j k l m n o p q r s t u v w x y z ab ac ae af ag ah ai aj ak" dir="ltr"><strong>This is a developing story. CIC News will continue to update it as IRCC releases additional Express Entry results today.</strong></span></p>
<p>The healthcare category draw was expected as last week IRCC<span class="ui-provider fz b c d e f g h i j k l m n o p q r s t u v w x y z ab ac ae af ag ah ai aj ak" dir="ltr"> confirmed it would have a round of invitations this week for 1,500 healthcare workers. This followed the first-ever <a href="https://www.reliablevisas.com/">category-based draw on June 28 in which 500 healthcare workers</a> with a minimum CRS of 476 received ITAs.</span></p>
<p>Today’s draws follow the <a href="https://www.reliablevisas.com/">first-ever invitations issued to candidates in science, technology, engineering and mathematics (STEM) professions</a> on July 5.  In yesterday’s round of invitations, 500 STEM candidates with a minimum CRS score of 486 received ITAs.</p>
<p><a href="https://www.reliablevisas.com/">Immigration, Refugees and Citizenship Canada</a> (IRCC) also invited 700 candidates in an all-program draw with a minimum CRS score of 511 in a surprise all-program draw on July 4. In an all-program draw, Express Entry  considers candidates in the <a href="https://www.reliablevisas.com/">Federal Skilled Worker Program</a>, the <a href="https://www.reliablevisas.com/">Canadian Experience Class</a>, and the <a href="https://www.reliablevisas.com/">Federal Skilled Trades Program</a>.</p>
<h2>Healthcare occupations for category-based selection</h2>
<p>Among the six new categories, healthcare occupations make up the largest number of eligible occupations with 35 in total:</p>
<ul>
<li>Audiologists and speech language pathologists</li>
<li>Chiropractors</li>
<li>Dentists</li>
<li>Dieticians and nutritionists</li>
<li>Education counsellors</li>
<li>General practitioners and family physicians</li>
<li>Instructors of persons with disabilities</li>
<li>Kinesiologists and other professional occupation in therapy and assessment</li>
<li>Licensed practical nurses</li>
<li>Massage therapists</li>
<li>Medical laboratory assistants and related technical occupations</li>
<li>Medical laboratory technologists</li>
<li>Medical radiation technologists</li>
<li>Medical sonographers</li>
<li>Nurse aides, orderlies and patient service associates</li>
<li>Nurse practitioners</li>
<li>Nursing coordinators and supervisors</li>
<li>Occupational therapists</li>
<li>Optometrists</li>
<li>Other assisting occupations in support of health services</li>
<li>Other practitioners of natural healing</li>
<li>Other professional occupations in health diagnosing and treating</li>
<li>Other technical occupations in therapy and assessment</li>
<li>Paramedical occupations</li>
<li>Pharmacy technical assistants and pharmacy assistants</li>
<li>Physician assistants, midwives and allied health professionals</li>
<li>Physiotherapists</li>
<li>Psychologists</li>
<li>Registered nurses and registered psychiatric nurses</li>
<li>Respiratory therapists, clinical perfusionists and cardiopulmonary technologists</li>
<li>Specialists in clinical and laboratory medicine</li>
<li>Specialists in surgery</li>
<li>Therapists in counselling and related specialized therapies</li>
<li>Traditional Chinese medicine practitioners and acupuncturists</li>
<li>Veterinarians</li>
</ul>
<p>In Canada, immigrants make up 23% of registered nurses, 36% of registered physicians and 54% of dental technologists. Canada relies on immigration to fill urgent gaps in the labour force. The most recent job vacancy data from Statistics Canada shows that there were 153,000 vacant positions in health care and social assistance in April 2023. This is the highest level  of vacancies across all employment sectors.</p>

<h2>Category-based selection draws</h2>
<p>On May 31, Sean Fraser, <a href="https://www.reliablevisas.com/">Canada’s Minister of Immigration</a>, announced that new categories had been finalized for  new category-based selection Express Entry draws.</p>
<p>The announcement was expected following a change to the Immigration and Refugee Protection Act in June 2022. The change gives Canada’s immigration minister the authority to select economic immigration candidates who have key attributes that align with Canada’s economic priorities or the minister’s mandate to promote the French language outside of Quebec.</p>
<p>The new categories are as follows:</p>

										<content:encoded><![CDATA[<p>When applying to work, study or immigrate to Canada, a foreign national must submit their application to <a href="https://www.reliablevisas.com/">Immigration, Refugees and Citizenship Canada</a> (IRCC). IRCC has service standards that provide the usual processing times for applications. However, there can be delays to these processing standards, causing the processing time of the application to be much longer than IRCC’s service standard.</p>
<p>Canada’s immigration system is experiencing a <a href="https://www.reliablevisas.com/">backlog</a> problem. Backlogs have been due to the COVID-19 pandemic, staffing shortages, high demand, and aging technology. Personal application delays can be due to missing documentation, or requirements like background checks that take extra time.</p>
<h3>What are your options?</h3>
<p>There are a few options if you are experiencing delays in your application.</p>
<p>The first thing an applicant should do is check their application status online through IRCCs website. It provides a processing times tool that is meant to accurately show the expected wait times. It is important to ensure that all documentation is complete and up to date, in order to avoid any unnecessary delays.</p>
<p>Once this is done, you may file a webform inquiry or call the IRCC customer center to see if they can provide you with a substantive response as to the reason for the delay in your application. If the inquiries to IRCC go unanswered or are unsatisfactory, you can try asking a local member of Parliament to file a status update request.</p>
<div id="cicnewsads-2024303393" class="cicnewsads-content-ads-300x600-and-300x250">
<p>For applications submitted after 2010, you can also file an ATIP, or an Access to Information and Privacy Application. An ATIP is a request for an applicant’s <a href="https://www.reliablevisas.com/">Global Case Management System</a> (GCMS) notes. Along with the GCMS notes, they can request their Computer Assisted Immigration Processing System (CAIPS) notes or their Field Operations Support System (FOSS) notes.</p>
<p>These notes will give you an idea about if anything is wrong in your application, or if the IRCC officer has noted concerns or doubts about your application. It also provides an opportunity to submit additional evidence addressing those doubts.</p>
<p>If necessary, you can also hire a lawyer to submit a formal request letter via the IRCC webform. This letter will emphasize that the processing time has exceeded the average processing time for the sort of application you are applying for, the efforts you have made to follow up with IRCC, and how the delay has negatively impacted you.</p>
<h3>Applying for an Order of Mandamus</h3>
<p>If the average processing time has passed and the other efforts and options described above are unsuccessful, then the last resort is to apply for an Order of Mandamus. The Federal Court will hear requests for these orders, which pressures IRCC to decide about the application.</p>
<p>It is recommended that you hire a lawyer to help you through this process. The threshold for an Order of Mandamus is high. Obtaining an Order will hinge on whether the applicant has exceeded the average processing time and is subject to unreasonable delays.</p>
<p>There are eight conditions that should be satisfied to warrant an Order:</p>
<ul>
<li>There must be a public legal duty to act (to process the application)</li>
<li>The duty must be owed to the applicant</li>
<li>There is a clear right to the performance of that duty, in particular that the applicant has satisfied all conditions giving rise to the duty and there was unreasonable delay</li>
<li>No other adequate remedy is available to the applicant</li>
<li>The order sought will be of some practical value or effect</li>
<li>The Court finds no equitable bar to the relief sought</li>
<li>On a balance of convenience, an order of mandamus should be issued</li>
</ul>
<p>One example of a balance of convenience that is in favour of an applicant is that the applicant is unable to renew their driver’s license or health card unless they have a valid <a href="https://www.reliablevisas.com/">work permit</a> or <a href="https://www.reliablevisas.com/">study permit</a>.</p>
<p>Waiting to hear about your application can be a stressful process that takes time and money. It is important to stay informed about the status of your application, to be proactive in updating your file and correcting any errors and being patient.</p>

										<content:encoded><![CDATA[<p>As many university and college programs come to an end, international students may be considering post-graduation options, which can include applying for a <a href="https://www.reliablevisas.com/">Post-Graduation Work Permit</a> (PGWP). This article will provide crucial insights into the PGWP application process to help you understand the intricacies of the program and the associated rules and policies.</p>
<h3>1. PGWP has a role in gaining Canadian work experience</h3>
<p>A major benefit of the PGWP is that is enables international students to gain professional work experience in Canada. This work experience is important when PGWP holders go on to apply for Canadian immigration.</p>
<p>Many of Canada’s over 100 different immigration pathways reward candidates who have studied and/or worked in Canada. Usually, a PGWP holder will need one year of professional work experience in a National Occupational Classification (NOC) code of 0, A or B to then be eligible to apply for a Canadian permanent residence program.</p>
<h3>2. To be eligible for the PGWP, you must have held full-time student status</h3>
<p>In order to be considered a full-time student, you must have held full-time student status every academic session of the program or programs of study completed and included as part of your post-graduation work permit application.</p>
<p>Canada has waived this requirement during the COVID-19 pandemic for some international students. Exemptions may apply to those who have begun or will begin a program between spring 2020 and summer 2022, or those whose program was already in progress in March 2020.</p>

<p>Other eligibility criteria include:</p>

<li>Completed studies in program that is at least eight months long at an eligible <a href="https://www.reliablevisas.com/">Designated Learning Institution</a> (DLI) List.</li>
<li>Study program must lead to a degree, diploma or certificate.</li>
<li>Received a transcript and an official letter from the eligible DLI confirming that the applicant has met the requirements to complete their program of study;</li>
<li>Graduated from: a public post-secondary institution, a private post-secondary school (in Quebec) that operates under the same rules as public schools in Quebec; a private secondary or post-secondary school (in Quebec) that offers qualifying programs of 900 hours or longer and results in the issuance of a diplôme d’études professionnelles (DEP) or an attestation de spécialisation professionnelle (ASP); or a Canadian private school that can award degrees under provincial law (for example, Associate, Bachelor’s, Master’s or Doctorate degree) but only if the student was enrolled in a study program that leads to a degree as authorized by the province.</li>
</ul>
<h3>3. The PGWP cannot be renewed and you can only apply for one PGWP in your lifetime</h3>
<p>Although you cannot renew your PGWP, you may be able to <a href="https://www.reliablevisas.com/">extend</a> your PGWP if it was limited in duration by your passport expiration date. The validity period of your PGWP may not go beyond your passport’s validity date. If this is the case, you have to apply for a work permit extension upon the renewal of your passport in order to receive the full validity of your PGWP.</p>
<p>If you decide to return to school after applying for the PGWP, you will not be able to receive a new PGWP for additional programs of study. Further, any period of full-time study while working will not count toward Canadian work experience for Canadian immigration purposes.</p>

<h3>4. You can apply to extend your PGWP before it expires if you qualify for a different type of work permit</h3>
<p>If your PGWP is expiring, you can look into a different type of <a href="https://www.reliablevisas.com/">work permit</a>, like an <a href="https://www.reliablevisas.com/">open work permit</a> or an employer-specific work permit. If you meet all the requirements of this work permit and apply for it before your PGWP expires, you may have maintained status to continue working in Canada.</p>
<h3>5. Maintained status grants you legal status while you wait for your extension to be processed</h3>
<p>Under the Immigration and Refugee Protection Act (IRPA), all foreign nationals that are authorized to enter Canada have temporary resident status. All temporary residents have an automatically imposed condition that they must leave Canada at the end of their authorized period of stay.</p>
<p>However, a temporary resident may apply to extend their period of authorized stay before it ends. If you have done this, your period of authorized stay as a temporary resident is extended by law until a decision is made. In addition, you are considered to have legal status as a temporary resident during the processing period.</p>
<h3>6. Some PGWP applicants can work full-time while they wait for the processing of their PGWP application, even if they leave and re-enter Canada</h3>
<p>If you are a graduate who applies for a PGWP before the expiry of your <a href="https://www.reliablevisas.com/">study permit</a>, you are eligible to work full-time without a <a href="https://www.reliablevisas.com/">work permit</a> while waiting for a decision on your application if all of the following apply:</p>
<ul>
<li>You are or were the holder of a valid study permit at the time of the post-graduation work permit application.</li>
<li>You have completed your program of study.</li>
<li>You met the requirements for working off campus without a work permit, that is, you were a full-time student enrolled at a DLI in a post-secondary academic, vocational or professional training program of at least 8 months in duration that led to a degree, diploma or certificate</li>
<li>You did not exceed the allowable hours of work</li>
</ul>
<p>You can remain eligible to work full-time without a work permit while waiting for a decision on your application even after leaving and re-entering Canada, but you must stop working immediately if you are notified by <a href="https://www.reliablevisas.com/">Immigration, Refugees and Citizenship Canada</a> (IRCC) that your work permit has been refused.</p>
<h3>7. Study permits become invalid 90 days after the end of the study program</h3>
<p>It is important to keep in mind that a study permit will become invalid 90 days after the end of a study program. Further, you must apply for a PGWP within 180 days of obtaining proof that you have met the requirements for completing your program of study.</p>
<p>The days will begin to run when your final marks are issued or the day formal written notification of program completion is received, whichever comes first.</p>
<p>If your study permit becomes invalid or expires before you apply for a PGWP, you are not eligible to <a href="https://www.reliablevisas.com/">work without a permit</a> and must either:</p>
<ul>
<li>Leave Canada and apply for a PGWP overseas</li>
<li>Apply to restore your status as a student by applying for a PGWP with the correct fees ($255) and paying the fees to restore your status as a student ($350)</li>
</ul>
<h3>8. If your study permit is expired before you apply for a PGWP, there are several options of how and where to apply</h3>
<p>If your <a href="https://www.reliablevisas.com/">study permit</a> becomes invalid or expires before you apply for a PGWP, there are a few options. One option is to leave Canada and apply for a PGWP overseas.</p>
<p>Interestingly, you can also submit an application “outside” Canada while still remaining physically in Canada. If you want to remain in Canada, you must maintain your status as a visitor until you receive the actual work permit.</p>
<h3>9. Ignoring the 120 days validity notice upon receipt of the PGWP application</h3>
<p>Upon submitting your PGWP application, you will receive an auto-generated letter from IRCC. The letter will grant a 120 day validity period to continue working. This can be ignored.</p>
<p>The 120 days is based on the theoretical work permit processing time of 120 days for in-Canada applications. Historically, IRCC met its service standards more than 90% of the time and most should receive a decision on their application before the 120 days expire. If the 120 days have passed and no decision has been rendered, you can request proof of authorization to work using the IRCC web form.</p>
<p>The validity date of the letter in no way overrides the authority that allows foreign nationals who meet the requirements to continue working until a final decision is made on their work permit application.</p>
<h3>10. Spouses and partners of PGWP holders may be eligible for a work permit</h3>
<p><a href="https://www.reliablevisas.com/">Spouses</a> and common-law partners of PGWP holders may be eligible to apply for a work permit under the C41 exemption.</p>
<p>In order for the spouse or common law partner to be eligible under C41, the PGWP holder must:</p>
<ul>
<li>Be authorized to work in Canada for a period of at least 6 months after spouse or common law partner’s open work permit application is received</li>
<li>Be employed in a high skilled occupation (NOC 0, A, B)</li>
<li>Be physically residing or plan to physically reside in Canada while employed</li>
</ul>
